Terms of service

Draft pending legal review. This text is a starting point, not legal advice. A lawyer must review it before contracting with customers.
This is an English translation provided for convenience. If it differs from the Spanish version, the Spanish version prevails.
1. Who we are and what you are buying
The service is provided by [RAZÓN SOCIAL O NOMBRE COMPLETO], tax ID (NIF) [NIF/CIF], registered at [DOMICILIO FISCAL]. By subscribing you contract the automatic generation of vertical promotional videos from the product photos and information you provide.
2. The videos are generated by artificial intelligence
The videos are produced entirely with generative AI models, including the person who appears speaking to camera: she is not a real person, she is a synthetic presenter, and the voice is synthetic too. Every delivered video carries a visible notice that its content is AI-generated, and that notice is part of the deliverable: you may not remove or crop it, or present the video as a recording of a real person.
AI is a non-deterministic process: two runs with the same input can give different results, and we don’t guarantee that any particular video will achieve a given commercial result.
3. The photos you upload
By uploading a photo you declare that you have the right to use it and to let us use it to generate your video: that it is yours or you hold a sufficient licence, and that it doesn’t infringe third-party rights (intellectual property, trademarks, or the image of identifiable people). You are responsible for that declaration.
You grant us a limited, non-exclusive and revocable licence to store and transform those photos for the sole purpose of providing the service. We don’t use them to train models or share them for our own advertising.
The resulting videos are yours: you can use them commercially, within the limit of the AI notice in point 2.
4. Subscription, quota and payments
Each plan includes a number of delivered videos per billing period. A video only counts when it is delivered: if it fails on our side or you cancel before approving the script, it isn’t deducted from your quota. Unused videos don’t roll over to the next period.
Payments are handled through Stripe. Prices are shown on the pricing page and include or exclude taxes as stated there.
5. Cancellation
You can cancel your subscription at any time from your account area. Cancellation takes effect at the end of the period already paid, during which you keep access. Periods already started are not prorated.
If you contract as a consumer, you have the 14-day right of withdrawal provided for in consumer law. Because this is digital content generated on demand, that right lapses for videos already generated once you expressly request their production.
6. Acceptable use
You may not use the service to generate videos that:
- Impersonate a real person or suggest that the presenter is one.
- Promote illegal products, or make false claims about them.
- Infringe third-party rights or include trademarks that don’t belong to you.
- Include sexual, violent or discriminatory content, or content aimed at minors.
We may suspend the account if we detect such use, without refunding the amounts corresponding to the improper use.
7. Availability and liability
We do what is reasonable to keep the service available, but we don’t guarantee a specific service level or the absence of interruptions. Except in cases of wilful misconduct or gross negligence, our total liability is limited to the amount you have paid us in the three months before the event giving rise to it.
8. Changes and governing law
We may modify these terms with reasonable prior notice; if the changes are to your detriment, you may cancel before they apply. They are governed by Spanish law and, unless a mandatory rule provides otherwise, are subject to the courts of the owner’s domicile.
